Father arrested after 11-year-old son accidentally shoots himself in the butt

Detroit, Mi (4-7-16) An 11-year-old boy is in the hospital after accidentally shooting himself Thursday morning. It happened in an apartment at the corner of Vernor and Hubbard in southwest Detroit.

“He was home alone,” said Commander Whitney Walton. “His father had left early for work and what our information is, he told the son, there is a rifle in the house if anything happens.”

The boy somehow found the loaded weapon. According to police, he started playing with it and it went off.

The child was in the buttocks. With no one phones in the home to call for help, he alerted his dad about the shooting through Facebook.

“The son had a cell phone but apparently recently lost it,” said Commander Walton. “I guess there was not a home phone for him to call his father so that was the only tool he had was social media to reach out to his father through instant message.”

His dad immediately called 911 and returned home. The boy was taken to the hospital where we are told he is in stable condition and walking.

“I think leaving an 11-year-old with a loaded rifle is a reckless act,” said Commander Walton. “I mean, you should not have an 11-year-old home alone with a rifle you have made them aware of. I mean, you need to have your weapon secured, put somewhere. Children are children. They’re going be curious.”

Police are still investigating to see how the child was able to shoot himself in the butt.

The child’s father is cooperating with police. Neighbors are relieved the child is okay.

“I don’t know how he had access to the gun,” said neighbor Alicia Dixon. “But from what I see and what I know his father is a terrific dad. I can tell by the way they interact with each other.”

The father has been arrested and could face charges. The case is being investigated by DPD’s Child Abuse Unit and Child Protective Services.

Las Vegas Police K-9 Killed by Friendly Fire

LAS VEGAS, NV (4-5-16) A man accused of killing two of his mother's neighbors Thursday was left paralyzed after a shootout with officers, and a Metro Police dog was accidentally shot to death by one of the officers, authorities said Monday.

Undersheriff Kevin McMahill said the suspect, James Craig Simpson, 31, was "shouting things that don't make sense" before the deadly shootings about noon Thursday in the garage of a house in the 9800 block of Fast Elk Street. Simpson killed Felecia Wimberly-Hughes, 47, and Brandon Hughes, 31, who entered the garage to help diffuse a confrontation between he and his mother, police said.

Minutes later, four Metro officers persuaded Simpson to drop his gun, but he picked it back up and engaged in a gun battle with police, McMahill said.

The four officers combined fired more than 20 rounds at Simpson, striking him multiple times, McMahill said. No officers were injured.

Simpson was left paralyzed and remains in critical but stable condition at University Medical Center, McMahill said.

The police dog, which was let loose to help stop Simpson, bit him and held on as Simpson ran from officers, McMahill said.

The dog was killed by a single shot fired by a Metro officer, McMahill said. Police have not determined which officer fired the shot, he said.

"This incident was highly charged, very dynamic and it touched a lot of people," McMahill said. "The sense of safety we like to associate with our homes was shattered that day."

McMahill lauded the two slain residents, for "going to the aid of their neighbor," and said the police dog died "doing what he loved to do and what (Metro) trained him to do."

McMahill said Simpson, who faces counts of murder, attempted murder, kidnapping and discharging a gun, will also likely face more charges upon completion of a police investigation, which is ongoing.

Thursday's officer-involved shooting was the fourth such incident in Metro's jurisdiction this year.

Worker killed at Northwest Side bar was an 'amazing ball of energy'

Chicago, Il (4-4-16) A man shot dead at a Northwest Side bar where he worked was an "amazing ball of energy" who "just wanted to make sure his family was always taken care of," his family said Monday.

"Even if you only met him once, his smile would stay in your heart forever," the family of Angel J. Ortiz Jr., 51, posted in an online appeal for money to help pay for his funeral.

Police said Ortiz was working at Brudder’s Bar & Grill at 3600 N. Pulaski Road when someone outside fired shots around 11:45 p.m. Saturday. He was taken to Advocate Illinois Masonic Medical Center in Oak Lawn, where he was pronounced dead at 5:39 p.m. the next day, police said.

Ortiz was apparently hit by a bullet that pierced the bar's front window. A van across the street had two of its passenger side windows shattered, but it was unclear if it was caused by gunfire.

Tina Anaya, who lives near the bar, heard three or four shots while she was at home. "It was a little scary because I was wondering where they came from because it happened so close," she said.

“There have been fights before,” said Anaya, who has lived about a block from the bar since August. “I can hear people yelling outside. I have two other bars that are close to me, where I live, but you can tell when people are leaving, with all the noise. The crowd is very young.”

But police said they are not aware of problems at the bar, though it has agreed to close for now.

“They’ve entered into a voluntary closure,” said Anthony Guglielmi, chief spokesman for the Police Department.

If the owners decide to reopen, they would work with police on a public safety plan, Guglielmi said. “It appears that this establishment is already working closely with us,” he said.

The longtime owner of the bar, George Michael, told the Tribune the bar would be closed until further notice out of respect for the Ortiz family. He said he was also offering a $2,500 reward for information that leads to an arrest.

“He was working one night a week checking IDs at the door,” said Michael, who opened the bar in 1991. “He was just trying to make some extra money for his family. It’s a tragedy.”

Brudder's was equipped with video surveillance both inside and outside the bar and the recordings have been handed over to the police.

According to Michael, there was no fight in the bar prior to the shooting. He said he believed the shooting was unrelated and that the bullet came through the window of the bar and accidentally struck the victim in the head.

“It was a totally random, senseless thing,” he said.

Michael gained notoriety several years ago when he wore a wire for the feds in an investigation of former Chicago cop Steven Mandell, who was convicted in a grisly plot to murder and dismember a businessman. Michael had pretended to go along with the plan to kill a Riverside landlord.

Ortiz's family has set up a memorial fund on the YouCaring website in hopes of raising $10,000 for funeral expenses. As of 4 p.m., $1,720 had been raised.

Arrangements were being handled by the Alvarez Funeral Home.

Weekend deadly shootings put spotlight on gun safety

ROCK HILL, SC (4-4-16) Two Rock Hill high school students are dead after being shot this weekend in two separate incidents. One happened in Rock Hill, the other in York.

The police department and community members said they're concerned - with the spotlight now on gun safety.

Police said one of the shootings was accidental and the other was random. Friends of both victims said both teen shootings were easily preventable.

Nicholas Carter said he knew both teens who died after being shot over the weekend, 17-year-old E'Monnie Dixon and 17-year-old Ja'Terreon Thorne.

"It really hurts. I woke up and found out. When I went to sleep everything was fine. I seen they were talking about JT got shot," Carter expalined.

Carter said what hurts even more is finding out one shooting was accidental, and the other random.

E'Monnie a young mother who went to Rock Hill High School - and Ja'Terreon from Northwestern High School.

"We feel for the families and their classmates. I wish I wasn't having this conversation with you today. It's such a sad time for our community," said Cpt. Bollinger.

Rock Hill police have ruled Ja'Terreon's death accidental. His friend Robreese Picket allegedly had the gun in his hand when it went off - killing the 17-year-old.

"The kids nowadays need to put the gun down. They really don't need to be doing any of this arguing and beefing or none of that. Innocent people are out there losing their lives over stupid stuff," Carter said.

The other shooting happened in York. Officers said E'Monnie was randomly shot at a party.

Now the community is coming together and greatly concerned about gun safety.

"You can't blame the parents because the parents are not out in the streets with these kids. Police are patrolling these streets so maybe a little but more of police protection," Curtis Hinton said.

Rock Hill Schools told FOX 46, "It has been an extremely sad 24 hours."

The police department wants to warn teens about the consequences of playing with guns - ad how it can end up deadly.

"Some of the trigger pressures, if you touch it it'll go off. Where some of it, you have to pull hard on the trigger to make it discharge," Cpt. Bollinger explained.

Police said Picket, the teen arrested for shooting Ja'Terreon, is charged with involuntary manslaughter.

York police are still looking for the suspect who shot Dixon.

Police found Chad Farner, 39, with a gunshot wound to the upper body at 9:42 p.m. Thursday at a home at 1910 S. Van Buren St., one block south of Interstate 40.

He was taken by ambulance to a local hospital where he died.
Farner was the owner of All Game Apparel, which provided uniforms to local sports teams.

Dustin Berry, a childhood friend of Farner’s who has organized a fundraiser for the family, said the shooting was accidental.

“It’s a tragedy, a freak accident,” Berry said. “It was a misfire of a gun that ricocheted, hit the floor and unfortunately hit Chad. It’s crushing for everybody who was there and even more crushing for the one who was holding the weapon.”

Farner’s death left a void in the lives of his two daughters, Cali, a freshman at Amarillo College, and Caitlyn, a freshman at Amarillo High School, Berry said.

To help fulfill the dreams that Farner had for his two daughters, Berry started a YouCaring fundraiser to help pay college tuition costs for the girls.

“It was something simple I could set up and I was really thinking of his daughters and what they will be doing now without their dad,” Berry said.

The fundraiser had raised $2,630 as of Monday. The goal is to raise $15,000.

“This is to offset some of those costs that their father would normally pay for,” Berry said. “College isn’t $15,000 for two girls and there will be a lot more stuff that’s required, but the main intent is to get the girls an education.”

Another Rock Hill, SC teen dies in gun negligence; girl 17 shot as friends "played" with gun

Rock Hill teen dies in accidental shooting, 1 arrested

ROCK HILL, SC  (4-3-16)  A 17-year-old Northwestern High School student died in Saturday night shooting that family members said resulted from three youths playing with a loaded gun. A suspect was arrested overnight after initially fleeing the scene.

The shooting was reported shortly before 10 p.m. Saturday at a home on 852 Horseman Drive in Rock Hill, according to Rock Hill police. The victim was found dead in the front yard of the home, police said.

Investigators initially ruled the shooting a homicide, but later said it was accidental.

Robreece Pickett, 20, of Rock Hill was handling the gun when it went off, said Rock Hill Police Capt. Mark Bollinger. Pickett has been charged with involuntary manslaughter and unlawful carry of a weapon.   His bond has been set at $115,000.

The deceased teen was identified Sunday as Ja’Terreon Thorne by the York County coroner’s office. Family members said he was a junior at Northwestern, who had earlier in his high school career briefly played on the Trojan football team.

Thorne’s father, Terrence Thorne, 41, who lived at the home, said his son and two of his friends were playing in a “man cave” area that had been built in the backyard of the home.

“Kids were playing with a gun and it went off and hit my son,” Thorne said. He said his son was shot in the chest, and that a neighbor called an ambulance.

Thorne and the boy’s mother, Tamika Douglas, 40, said they did not know where the gun came from or what kind of gun was used. Douglas said there were no guns at the home.

Breanna Roberts, 18 and a first cousin of the deceased boy, said no one else was home at the time of the shooting. She said the two friends dragged Thorne from the back yard into a side yard and sprayed him with water from a hose.

Roberts said one of the friends fled on foot while the second friend remained at the scene with Thorne.

Police said late Saturday that they were searching for a lone gunman dressed in black.

Roberts described Thorne as a happy, funny youth who enjoyed sports and liked playing video games and going shopping. He was well known and had many friends, she said.

“He was an outgoing person,” she said. “He was a funny person. I loved him so much.”

Terrence Thorne described his son as “an all-out kid, he loved sports, he got along with everybody. Loving, smart.”

Last month, a teenager was gunned down in a mid-day shooting on Keels Avenue. Jarrius Harding, 18, was fatally shot in the March 4 homicide.

Charges possible in accidental shooting death of Battle Creek woman

Battle Creek, Mich. (4-1-16) Kayla Babick’s birthday was last week and her family did what they could to remember her. She was shot and killed on Valentines Day when, according to Battle Creek police, her boyfriend was cleaning his gun. They said they believe the case to be accidental. But now the it's in the prosecutors hands.

"We’re looking into how much responsibility does a firearm owner have to make sure that firearm is safe to where it won’t go off or it won’t be an incident like this that takes place," said Detective Sergeant Troy Gilleylen with the Battle Creek Police Department.

Investigators said they've conducted multiple interviews with the boyfriend, 25-year-old Deangelo Gaines. Gaines initially told them that his .45 caliber gun went off when he was cleaning it. But then he said the gun was lying on the bed when Babick laid on top of it. When she tried to move it, it discharged.

"The firearm was left out, loaded obviously," said Gilleylen. "What we’re now looking at is whether or not someone’s careless acts contributed to the death of a human being."

Gilleylen said there are no laws stating a gun has to be locked or stored away when it's inside a residence. However, the department is looking into whether it was reasonable to have it out in the open.

"She wasn’t taking the gun apart when it went off," said lead detective Scott Silverman. "She wasn’t cleaning it when it went off. She wasn’t playing with it when it went off. She was actually on the telephone talking to her mother."

Due to a number of interviews with Gaines and other witnesses, police believe the incident to be unintentional. But it is a peculiar case.

"For an adult I think it is unusual," said Gilleylen. "I know we do hear on occasion of a child that’s able to get a hold of a parent or firearm that’s left out. And I think that it happens all too much."

Update on Accidental Shooting

Putnam County, FL (3-9-16)  This is an update regarding the accidental shooting in Putnam County on 3-8-16. Our investigation has revealed that the firearm was legally owned by the victim and the child came to possess the firearm without the victim’s knowledge. Florida Statute makes it a misdemeanor for a person to store or leave, on a premise under his or her control, a loaded firearm in such a manner that it is likely a child can gain access to the firearm. The investigation is ongoing to determine exactly how the firearm was stored in the vehicle. The primary concern for PCSO at this time is to provide the necessary services and assistance to the young man and his family. Due to her medical condition, Detectives have not been able to interview the victim and any decision on the filing of criminal charges will not come until after we speak with the victim. It is not known when we anticipate speaking with the victim. The Florida Department of Children and Family Services have been notified and are reviewing the case as well. The four-year-old child remains with family members.

The Sheriff's Office has received several questions about the Florida Statute regarding the safe storage of firearms. Here is the entire statute:

790.174 Safe storage of firearms required.—

(1) A person who stores or leaves, on a premise under his or her control, a loaded firearm, as defined in s. 790.001, and who knows or reasonably should know that a minor is likely to gain access to the firearm without the lawful permission of the minor’s parent or the person having charge of the minor, or without the supervision required by law, shall keep the firearm in a securely locked box or container or in a location which a reasonable person would believe to be secure or shall secure it with a trigger lock, except when the person is carrying the firearm on his or her body or within such close proximity thereto that he or she can retrieve and use it as easily and quickly as if he or she carried it on his or her body.

(2) It is a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083, if a person violates subsection (1) by failing to store or leave a firearm in the required manner and as a result thereof a minor gains access to the firearm, without the lawful permission of the minor’s parent or the person having charge of the minor, and possesses or exhibits it, without the supervision required by law:

(a) In a public place; or

(b) In a rude, careless, angry, or threatening manner in violation of s. 790.10.

This subsection does not apply if the minor obtains the firearm as a result of an unlawful entry by any person.

1(3) As used in this act, the term “minor” means any person under the age of 16.
