Florida State Attorney Brad King freed him to shoot again; Chicago 7 yr old dies, shot himself in head

Brooksville man who got away with homicide in the news again.

Dade City, Fl (3-20-16) The man responsible for the July 26th 2014 homicide of Katherine Hoover and her unborn son, Rehlin, is back in the news. Yesterday, the now 37-year-old William Mathew DeHayes, was arrested by the Hernando County Sheriffs office for publicly discharging a gun.

Almost two years ago DeHayes got away with homicide, despite the fact that he admitted to being under the influence of multiple prescription narcotics, as well as behaving recklessly with the .22 caliber pistol he was showing off with his practiced ‘cowboy style’ gunslinging moves in the presence of 25-year-old Hoover who was five months pregnant.

Hoover’s mother Donna Bryan has devoted her life to bringing awareness to the circumstances surrounding her daughter’s death. The State Attorney’s office never filed charges against DeHayes in the accidental shooting of Hoover and her son. Bryan is trying to get Governor Rick Scott to order State Attorney Brad King to re-open the investigation.

Bryan claims the Hernando County Sheriff’s office botched the investigation of her daughter’s homicide.

The explanation from the sheriffs office is that “he didn’t appear high.” During the initial interview DeHayes stated he had taken Methadone, Soma and Loritab in ‘prescribed’ doses. He then went on to say he didn’t know what happened or what made the gun go off. He told detectives that the last time he fired the gun was on the 4th of July. DeHayes said, “somehow” ammunition stayed in the gun.

Hoover’s brother, James Sorace wrote on Facebook, ” Who ever is protecting him is going to realize he’s becoming a liability.”

“I’m fuming,” said Donna Bryan, mother of Katherine Hoover, “This guy has already killed two people – he’s dangerous.”

Yesterday’s incident took place at 4335 Cimarron Way in Dade City.

Hoover’s mother has this to say, “This guy has already killed two people. Who is he going to kill next? Who’s child is going to die next?”

So far, Bryan has collected over 13,650 petitions asking Governor Scott to re-open the investigation. The petition is located here: https://www.change.org/p/state-attorney-brad-king-gives-free-pass-to-baby-killer?recruiter=192472051&utm_source=share_petition&utm_medium=facebook&utm_campaign=share_facebook_responsive&utm_term=des-md-share_petition-custom_msg

In yesterday’s incident, DeHayes is charged with violating Florida Statute 790.15.1–Discharging a weapon in a public place. He is currently free on $1000 bond.

We are currently waiting for the Hernando County Sheriff’s office to release the details surrounding yesterday’s the incident. As soon as we receive the official report, we’ll update the story.

Gun Shops Talk Gun Safety After 12-Year-Old Boy Shot in Possible Accidental Shooting

Lubbock, TX (3-21-16) Saturday, Levelland Police said a 34-year-old man shot a 12-year-old boy in the head. While the shooting is still under investigation, police say it's possible the shooting was accidental.

The boy was rushed to Covenant Children's Hospital where the hospital confirmed that he is in fair condition as of Sunday night.

This isn't the first time in recent months when a child was the accidental victim of gunfire on the South Plains.

In February, a five-year-old Lubbock child was killed, accidentally shot by his father who was cleaning his rifle. In November of 2015, a two-year-old in Lubbock County was also injured after being shot accidentally.

J.D. Clay, the retail manager for Sharp Shooters Gun and Knife in Lubbock, said that is why his business takes extra caution in instructing customers about gun safety.

Clay said that when he works with customers who are new gun owners, he always asks if they have children in their home. If they do, he asks them even more questions about their gun safety plans.

"Well, where do you intend on keeping the firearm? Is it going to stay on your nightstand? Are you going to separate your magazines and the ammo somewhere different?" Clay said.

He added that often, gun accidents boil down to not truly knowing whether a firearm is loaded. He recommends that gun owners establish a system, whether marking firearms as loaded or unloaded, or keeping firearms in a safe, to make sure a loaded firearm isn't mistaken.

"An unloaded firearm is safe, it's the safest you can be, you just gotta always chamber check it," Clay said. "It's always pulling out that magazine and opening it up, as soon as you've done that and you've cleared it, it's about as useful as a brick."

While Clay spends most of his time working around guns, he said he still thinks about the fact that someone he knew growing up was injured by gun violence in a tragic way.

"It's things like that instill a sense of safety in the back of our minds when we're exposed to it and we remember that 'Oh yeah, chamber check [the gun],' I remember what happened 10 or 15 years ago," he said.

Clay also recommended that while checking or cleaning rifles, it's best to keep weapons pointed in a safe direction, even if you think they are unloaded.

He said accidents are a reminder that gun owners, especially gun owners with children, need to keep a close eye on their weapons.

"To the family and everything else, our hearts go out to them," Clay said of the family in Levelland. "But fortunately, it could have been a lot worse, they are very fortunate in how it went down."

7-year-old Englewood boy fatally shoots himself

Chicago, Il (3-20-16) A 7-year-old boy fatally shot himself Sunday in his home in the Englewood neighborhood on the South Side, Chicago Police said.

The Cook County medical examiner’s office identified the boy as Devon Lofton. Devon accidentally shot himself at his home in the 6700 block of South Aberdeen Street at 3:50 p.m., police said.

Devon was taken to University of Chicago Medicine Comer Children’s Hospital with a gunshot wound to the head. He was pronounced dead at 4:36 p.m., authorities said.

Claudia Harris, a next-door neighbor and close friend of the family, said she was in her home when one of Devon’s brothers ran in and yelled for her to call police.

“I didn’t know what was going on at first, but I knew it was bad,” Harris said.

Devon, a first-grader, lived in the home along with his mother, grandmother and several siblings, Harris said. She wasn’t sure who was at the home when the shooting happened.

Bernard Warfield, another next-door neighbor to the south, said he saw Devon and greeted him when the boy rolled up to his home on his red bicycle just a few hours before the shooting.

“He said ‘See you later,’ the last words. . . . It’s traumatizing,” said Warfied said, who recalled seeing the boy outside playing football on the block regularly.

“He was a great kid. It’s heartbreaking,” Warfield said.

Andrew Holmes, a community activist and crisis responder for Chicago Survivors, said he had spoken with some of Devon’s family members, including the boy’s mother, who was taken to a hospital after going into shock.

According to the preliminary investigation, Holmes said Devon and at least one other child were playing with a gun, which they might have mistaken for a toy.

Holmes said Devon accidentally shot himself in the chest, though police have said he suffered a head wound. Investigators were performing gunshot residue tests on the boy’s hands to confirm it was self-inflicted, Holmes said.

The boy’s grandmother was home at the time, Holmes said. Investigators are trying to figure out whose gun it was.

“No matter if they thought that was a BB gun or a toy, that weapon should not have been inside that home,” Holmes said.

Police: False shooting reports leeching resources real Savannah area crime

Savannah, Ga (3-21-16) It was a sunny November afternoon when a 20-year-old Savannah man told police that a stranger shot him while he was playing basketball on East 54th Street. Officers interviewed him at the hospital while others processed the crime scene and canvassed the area looking for leads on a suspect.

But the man recanted his story hours later and admitted the gun belonged to him and was discharged accidentally during a basketball game.

“We get reports like this all the time,” said Savannah-Chatham Police Sgt. David Barefield.

Last week, two 17-year-olds reported they were shot at from a nearby car, an incident that left one of them injured. But hours later, again, the teenagers confessed that one accidentally shot the other and police recovered the gun used during the incident.

Law enforcement officers say the growing trend of falsely reported shootings is troublesome because it elevates Savannah’s crime statistics, wastes department resources and distracts police from investigating legitimate incidents.

The false shooting report from November is only one of hundreds police receive each year, Barefield said. They inflate Savannah-Chatham’s crime statistics by about 10 percent annually.

“When we have these shootings happen, then all of our detectives are focused on what just happened,” he said, “We have people go to the crime scenes, people that go to the hospital, people that are interviewing witnesses. It’s a lot of wasted resources that we have to use.”

And it’s not just police resources and manpower that gets involved, Barefield said.

“Sometimes we’ll get Chatham-Savannah Counter Narcotics Team involved,” he said. “We’ll get other agencies involved to identify a suspect that doesn’t exist because the crime didn’t happen. There’s just so many man hours and days that can be wasted on a case like that, and they could be better used on a case somewhere else. It’s very disheartening.”

People who file the false reports vary in age, race and criminal backgrounds, but the most common reason for lying is to avoid jail time, said police Major Richard Zapal.

“If you’re a convicted felon, you cannot possess a gun,” he said. “What better indicator is there that you possess a gun other than you got shot — unless, of course, you say somebody shot me and that, of course, explains away why you didn’t have a gun because somebody else shot you.

“That’s usually the most common reason. Another reason is that ‘I was involved in a drug deal and I was shot.’ Very rarely is it that you were just walking down the street and were shot randomly.”

The problem exists in other departments around the region, too.

In April, Port Wentworth police arrested a man for shooting himself and then orchestrated a story blaming a girlfriend for the shooting. The man was accused of various crimes, including criminal defamation. The man’s girlfriend was originally taken into custody as a suspect, but was later released after being interviewed. Port Wentworth police officials could not be reached for comment.

Police say they prosecute those who file false reports when evidence is available. Filing a false police report is a misdemeanor and giving police a false statement is felony.

Woman Shot by Police in Virginia was Brandishing Fake Gun

Norfolk, Va. (3-20-16) Police in Norfolk, Virginia, shot and killed a woman Saturday who was brandishing what turned out to be a fake gun.

Investigators with the Norfolk Police Department came upon an argument involving at least one man and one woman just after 1 a.m. They saw the woman threaten the unarmed man with what looked to be a handgun, police said.

An investigation later revealed that the weapon the woman had was a nonfiring replica firearm.

The officers said they gave verbal commands, which the woman ignored. They fired their service weapons after the woman “made a threatening motion with the handgun,” according to police.

The woman, identified as 25-year-old India M. Beaty, was pronounced dead at the scene.

“Any loss of life is tragic,” Norfolk Police Chief Michael said Saturday. “This morning’s events affect not only my officers and Ms. Beaty’s family members, but our entire community. My thoughts and prayers go out to Ms. Beaty’s loved ones and we appreciate the public’s patience as we continue this investigation.”

The investigators who fired their weapons have not been identified. Both have been placed on administrative duty pending the results of an investigation, as per policy.

Of seven shootings, the oldest is 23, college kid shot mistaken as burglar

Family of 12-year-old Levelland boy said shooting was accidental; hospital confirms boy is recovering well

Levelland, Tx (3-20-16) Family members of a 12-year-old Levelland boy who was reportedly shot in the head Saturday afternoon said the shooting was accidental.

His older sister, 18-year-old Heaven Garcia, said she has two children of her own and the accident left her terrified, yet thankful at the same time.

She said while she did not see the accident, she heard a loud “boom.” When she walked into the living room, she said, she saw what had happened and called 911.  “He had blood running down his face and it was ashy,” she said.

Levelland police responded before 1 p.m. to the house in the 1400 block of 12th Street. Police said they had received several 911 calls to the home in reference to the gunshot victim.  When they arrived, police said, they found the boy had been shot in the head by a 34-year-old man. Soon after, police determined it was a possible accidental discharge of a weapon.

He was taken to Covenant Women’s & Children’s Hospital in Lubbock where a hospital representative said he was in stable condition, possibly good condition.

The boy’s other sister, 16-year-old Audrie Garcia, said the accident occurred as her mother was showing a male relative a few firearms.

“My mom wanted to get rid of the guns,” she said.

The male relative was looking at the guns on the bed while the boy was in the room’s closet, she said.

After hearing the noise, she said, she walked into the room and saw her brother on the floor in the closet. She said her mother begin yelling for her to call 911.

Older sister Heaven said her brother was doing fine, although he does have some pellets embedded in his face and shoulder.  Both Heaven and Audrie said they are thankful that was the extent of his injuries.  “I want people to know that he’s fine,” Audrie said. “He’s going to heal well, and thank you for all the prayers.”

Levelland police said the case is under investigation.    lucinda.holt@lubbockonline.com

15-year-old killed in Cedar Rapids shooting

CEDAR RAPIDS, IA (3-19-16) For the second time in just over six months, a 15-year-old has been shot and killed in Cedar Rapids.

The circumstances of the shooting that led to Senquez Jackson’s death remain under investigation, but Cedar Rapids Police Chief Wayne Jerman said Saturday night the incident does not appear to be an “intentional assault.”

Jerman said investigators have interviewed the person believed to have pulled the trigger. At this time, the shooting is being treated as a death investigation.

“It’s another tragic loss of life,” Jerman said. “It didn’t need to happen, shouldn’t have happened, but it happened. It’s tragic from all aspects.”

Senquez Jackson was pronounced dead at 5:24 p.m. Saturday, less than 24 hours after police, fire and emergency responders were called to 1424 Bever Ave. SE for a shooting. That call came in at 5:45 p.m. Friday.

Jackson was found inside the residence suffering from a gunshot wound. Jerman said the shooting took place inside the residence. Officials are working to confirm whether or not Jackson lived at the Bever Avenue residence.

Jackson’s shooting does not appear to be intentional at this time, Jerman said. Authorities are working to determine the facts and circumstances of the incident.

“There are still more interviews that need to be completed by investigators, and then we need to look at what the facts and evidence are once more of those interviews are completed,” Jerman said. “It does not indicate it was a drive-by or assault.”

Jerman said police have spoken with the shooter and other people inside the residence at the time of the shooting. He declined to say whether the shooter is in custody at this time.

“He’s been spoken to,” he said, adding that everyone inside the house appears to have been acquainted with each other.

Jackson’s death also marks the second time in just more than six months that a 15-year-old was killed in southeast Cedar Rapids. Aaron Richardson was shot near 16th Street and Park Avenue SE on Sept. 6, 2015. He died of those injuries.

A then-14-year-old, Robert Humbles was arrested in connection with Richardson’s killing. Humbles originally was charged with first-degree murder in Richardson’s death, but pleaded last December to voluntary manslaughter, reckless use of a firearm resulting in serious injury and going armed with intent.

Humbles admitted during the plea hearing to shooting and killing after two rival groups had exchanged threats through text messages and on Facebook.

Humbles faces 25 years in prison but, according to the plea agreement, he is being prosecuted as a youthful offender, which means he will be placed in a youth residential treatment center or more restrictive facility, such as the Eldora State Training School for Boys, until he turns 18.

Joseph P. Perkins, 24, was found dead at Cedar Valley Townhomes on Feb. 23 after police responded there for reports of multiple gunshots. Another man was also shot, but his wounds were non-life threatening. No arrests have been made in that case.

Patient accidentally shoots himself at VA Medical Center annex

BIRMINGHAM, Ala. (WIAT) – A veteran came into the lobby of the Birmingham VA Clinic, Friday morning, with a weapon and a gunshot wound. According to Birmingham VA spokesman, Jeff Hester, the patient had shot himself inside of his car in the parking deck. Jerry Snider, a veteran who was at the clinic, came in around the same time. “I parked on the second floor, got on the elevator to ride down, and there was blood all in the elevator,” he said. “All the way into the entrance there to the lobby. That’s all I saw. And a man laying there.”

Hester says, to the best of his knowledge, the shooting was an accident. However, the incident will be reviewed by several law enforcement agencies. Weapons are not permitted on any federal facility. “He willingly gave over the weapon,” Hester said. “It was nothing confrontational. They called down the physician and then we called paramedics and the physician provided medical attention until we got him to the appropriate level of care.”

The man was hit in the arm, and his injuries do not appear to be life threatening. The gun was confiscated by police as soon as he entered the lobby. “I think everybody did a really great job,” said Hester. “Right now our leadership is down there with some of the staff at the clinic just thanking them for what they did and and making sure that everybody is okay, because it is startling when you hear that.”

It was startling for some in the area. Snider says he didn’t know what was happening when he came across the scene in the lobby. “There were people all around him,” he explained. “They’re not suppose to bring any kind of weapon on property, so that’s about all I can tell you.”

“We didn’t feel at any point that anybody else was in danger,” said Hester. “Our concern was to get the patient the care and get him to the appropriate level of treatment.” The facility never went on lock down. However, Hester says the staff is prepared in case a situation arises. “All of our staff have been well trained for those kind of situations, and that’s why we have a police presence at that facility.”

Reckless shooter indicted for heroin possession charge

PORTSMOUTH, NH (3-18-16) A Dover man, previously convicted for firing a handgun and grazing a neighbor with a bullet, was indicted for a pair of felonies alleging his possession of heroin and his attempt to hide a hypodermic needle from investigating officers.

Corey Field, 27, of 2 Willowbrook Apartments, Dover, was indicted by the most recent Rockingham County Superior Court grand jury. One of the indictments alleges Field was in possession of heroin on Dec. 17 in Portsmouth and has a prior drug-related conviction. The indictment states that Field was convicted for dealing prescription drugs in Dover on Nov. 5, 2010.

The second indictment, for falsifying physical evidence, alleges Field concealed a hypodermic needle in a trash bin outside a Portsmouth business, in a deliberate attempt to impair a police investigation.

An indictment means the grand jury found enough information to take the case to trial and is not a finding of guilt.

Field was arrested for gun-related charges of reckless conduct and falsifying evidence in 2014, when he lived at of 16 Leonard St. in Rochester. Police said he admitted to accidentally firing his .40 Smith & Wesson Sigma pistol and that a bullet went through his wall, across the street and into a home where it hit 20-year-old Josh DeMeritt in the forehead. Police said at the time that DeMeritt was uninjured because the bullet "lost momentum" after going through walls and windows.

After the accidental shooting, Field was charged with felony counts of reckless conduct and falsifying physical evidence, the latter charge alleging he hid the spent bullet casing from police to hinder the investigation. Rochester Police Capt. Gary Boudreau said Friday the charges were reduced to misdemeanors as part of a plea deal and the case is closed with two guilty pleas.

Police: Boy Accidentally Shoots Himself in Annandale

FAIRFAX COUNTY, VA (3-17-16) Fairfax County Police say that a 12-year-old boy accidentally shot himself late Wednesday night in Annandale.

Mason patrol officers responded to the 7800 block of Thor Drive (see map below) late Wednesday night, just after 11 p.m., for a report of a shot person, according to police.

When they arrived, police found a 12-year-old boy in front of the address, suffering from an apparent gunshot wound to the lower body, police said.

Officers used their issued trauma kit to render first aid until rescue arrived, they said. Police said the gunshot injury was non-life-threatening.

A preliminary investigation suggests that the wound was unintentionally self-inflicted, police said. The investigation is ongoing, but there was never any apparent threat to public safety, according to police.

When contacted, police would not release any other details.

There is no word on who called police, what kind of gun it was, who owned the gun, if it is legally registered, where it was kept or how the boy happened to gain access to it.

Also, it appears the boy was home alone, but information was not available from police on whether that was the case or not.

Children in Fairfax County age 11 to 12 years old may be left alone for up to 3 hours, are not to be left alone late at night or in circumstances requiring inappropriate responsibility.

The Fairfax County Police Department has seen an increase in firearms related accidents which occur in residences, according to the department and offers these gun safety tips:

Always treat guns as if they are loaded. Always keep the gun pointed in a safe direction. Whether you are shooting or simply handling a gun, never point it at yourself or others. Common sense should dictate which direction is safest. In a single family or townhouse for example, the lowest floor of the residence such as the basement is generally the safest place to point the gun. Being mindful of the fact that a bullet can penetrate ceilings, floors, walls, windows and doors.

Always keep your finger off the trigger until ready to shoot. Whether loading or unloading a gun, rest your finger outside the trigger guard alongside the gun. Do not touch the trigger.

Always keep the gun unloaded until ready to use. If you do not know how to check to see if a gun is unloaded, leave it alone. Carefully secure it, being certain to point it safely and to keep you finger off the trigger. Seek the advice of a person in the household who is knowledgeable in handling firearms for assistance.

Keep firearms secured in approved gun lockers or safes. Keep ammunition separated. By separating ammunition from the firearm, it will further ensure safety in the household in case there is any unauthorized handling of the firearm. Gun locks are also encouraged as an added level of security.

Aiken man claims he accidentally shot man in neighboring apartment

Aiken, SC (3-17-16) Department of Public Safety officers arrested an Aiken man Tuesday after he allegedly shot a 37-year-old Williston man through the wall of a Fairfield Street apartment.

Michael Harley, 30, of 433 Fairfield St., is being charged with discharging a firearm in the city, possession of a pistol and possession of cocaine, second offense.

Officers were called to a Fairfield Street apartment around 4 p.m. Tuesday in response to man being shot in the knee, according to a report provided by the Aiken Department of Public Safety.

Investigators found a bullet hole in the wall of the apartment, which was consistent with a gun shot from the adjacent apartment, according to the report.

Officers knocked on the neighboring apartment and got no answer; a woman approached a short time later, claiming to live at the apartment with Harley and said they both fled the scene after the shot was fired, the report said.

The woman called Harley to get him to return, and they both claimed Harley was playing with his pistol when it accidentally fired, according to the report.

Harley admitted to officers his firearms were at a neighbor’s house where he hid them; officers went to the neighbor’s residence where they retrieved a .380 semi automatic pistol, which came back stolen, and an assault rifle, according to the report.

Harley was searched before being arrested and a $1 bill containing a small amount of cocaine was also found in his pocket, the report said.

The victim was transported to a nearby hospital by EMS, with non-life-threatening injuries.  Harley is still being held at the Aiken County detention center as of Thursday afternoon.

Pregnant Tennessee teen, 15, among 6 teens shot in gun negligence today, 5 dead

Teenager dies in accidental shooting inside Northland home

KANSAS CITY, Mo. (3-15-16) A teenage boy has died from an apparently accidental shooting in the Northland. Police sources tell FOX 4 the shooting happened on Monday night inside a home near North Flora and Northeast 80th Street.

Police haven’t given many details about what exactly happened inside the home. A spokesperson says around 10 p.m., officers were called to the home to investigate a disturbance.

When officers arrived, they learned that a teenager who lives in the home accidentally shot another teenage boy who was apparently staying with the family. Sources say the victim may have been 16 years old.

Neighbors say they heard one gunshot ring out from the house.

“From a couple of neighbors, we heard that they saw a lot of police cars. They saw the parents were in separate police vehicles. It`s every parent`s worst nightmare to hear of an accidental shooting, especially when there`s children involved, very tragic,” said one woman who lives nearby.

Neighbors also say they saw police take the parents and their teenage sons away in separate cars. As of now, no one has been arrested or charged in connection with the shooting.

Pregnant teen killed with 12-gauge shotgun, suspect says shooting accidental

Whitehaven, Tn (3-15-16) A man charged in the shooting death of a pregnant 15-year-old girl told police that the victim was playing with a 12-gauge shotgun when it fired hitting her in the head as he tried to take the gun away from her, according to arrest records.

Terry Turner, 24, has been charged with second-degree murder in the shooting death of Vianca Harris Monday at the Valley Forge Apartments in the 100 block of Hillview Avenue, off Neely Road in Whitehaven.

When police arrived around 1 a.m., they found the teen slumped over the couch with a gunshot wound behind her left ear, according to the arrest affidavit.

Harris was pronounced dead on the scene by paramedics with the fire department. Her death was ruled a homicide by the medical examiner's office, according to an arrest affidavit.

Police said Harris was four to five weeks pregnant when she was killed. Turner now also faces charges in the death of Harris' unborn child.

A witness told police that he was in the living room with the victim and the defendant when the shooting occurred. The man alleged that he saw the defendant get the shotgun from a closet, rack the gun and fire one shot at the victim, hitting her in the head, according to an arrest affidavit.

The defendant told police the shooting was accidental because he was trying to take the gun away from the victim.

Turner was arrested and remains in jail on a $200,000 bond.

According to court records, Turner was arrested last year charged with identity theft trafficking.

In that incident, police arrested Turner and another man after officers found more than a dozen identifications that did not belong to them in their car after they were pulled over on a traffic stop.

Police said Turner gave police a fake name and age before admitting that he had warrants. The arrest affidavit refers to Turner as "she." Turner was booked as a woman and taken to Shelby County Jail East. Authorities later discovered Turner was male. Turner was then transferred to the men's jail at 201 Poplar.

Accidental firing of weapon inside house kills Chattanooga woman

Chattanooga, Tn (3-15-16) The shooter sat in the sun with his head in his hands as investigators walked in and out of the house beside him Tuesday afternoon.

At 1:09 p.m., Aaron Randal, 22, was handling a weapon when it discharged and he unintentionally shot and killed 19-year-old Carly Ellis inside the home at 1206 Lewis St.

The bullet went through a wall and hit Ellis in the neck, according to Chattanooga police. Investigators have not said what type of weapon was involved.

"One occupant of the house was handling a firearm and negligently discharged that firearm," police Chief Fred Fletcher said.

After the shooting, after the ambulance left and police arrived and the crime scene tape went up, Randal sat silently on the ground, not looking at anyone as investigators gathered evidence and processed the scene. Blood soaked his pants.

Later, he was handcuffed and placed in the back of a police car. He has not been charged with a crime, but Fletcher said he hasn't ruled out charges. Investigators will work with District Attorney Neal Pinkston to determine if charges should be brought, Fletcher said.

"We are doing a complete investigation, and if somebody behaved in a way that was criminal we will work with the district attorney to make sure that the community has the opportunity to hold people accountable to any criminal charges," Fletcher said.

It's unclear how Ellis and Randal knew each other. They weren't related, Fletcher said, and the woman did not live in the home. Neither Ellis nor Randal have criminal histories in Hamilton County, court records show.

Ellis is the sixth person in Chattanooga to be killed so far in 2016. Seven days ago, 41-year-old Michael Hines was shot to death at his mother's home in Brainerd. And on March 2, 71-year-old Orlandus Metcalfe was gunned down while at home in his bed.

Ellis, who worked at downtown club Raw Chattanooga, is at least the second person to be unintentionally shot and killed in the Chattanooga region this year — on Feb. 29, 3-year-old Gavin Pittman found a gun in a glovebox and accidentally shot and killed himself in Apison. His mother, Kelly Pittman, later was charged with criminally negligent homicide.

A woman on the front porch of the home on Lewis Street declined to speak with the Times Free Press Tuesday.

TPW: Weatherford senior shot himself while hunting

Weatherford, Tx. (3-15-16) A Weatherford High School senior killed in a hunting accident Monday morning apparently accidentally shot himself, according to information from the Wise County Sheriff’s Office and the Texas Parks and Wildlife Department.

Brennan Weikel, a 17-year-old football player on spring break this week, was hunting with his stepfather and one or two other relatives early Monday morning in Wise County when the shooting occurred, according to officials.

The group had a lease license and were hunting hogs overnight on a property off County Road 3825 south of Runaway Bay near the Wise County and Jack County line, according to Game Warden Penny Nixon.

“They were placed in individual ground blinds, the little wooden ones,” Nixon said. “His stepfather shot a hog and called the victim to ask him to help retrieve it. And the stepfather reported that immediately upon hanging up with the stepson, just seconds later, he heard a shot. It came from the blind where the young victim was.”

After getting no response to a text asking about the shot, the Weikel’s stepfather, who was approximately 300 yards away, went over to the stand and found the teen crumpled up in the corner, his feet tangled up in a chair, according to Wise County Sheriff Lane Akin.

“There may have been some hunter inexperience involved,” Nixon said.

Akin said the gun is believed to have gone off when he leaned over the rifle, which had a round chambered and the safety off, and all indications point to an accidental shooting.

Nixon said it appears that when Weikel went to stand up and move out of the blind, he reached for the grip of the rifle and squeezed the trigger as he moved, shooting himself with a .243 round.

“It was instantly fatal,” Nixon said. “It’s a real tragedy.”

Weikel had completed a gun safety course five days earlier and was licensed to hunt, according to law enforcement officials.

The teen’s body has been sent to Dallas for autopsy and the Remington 789 sent to a firearms examiner, according to Akin, who said the local Texas Ranger is also assisting in the investigation.

A funeral service for Weikel will be held at 11 a.m. Saturday at New River Fellowship Church in Hudson Oaks. Visitation has been scheduled for 6 p.m. to 8 p.m. Friday at Greenwood Funeral Home on White Settlement Road in Fort Worth.

Man drunkenly shot himself at Bristol Polish American Club: police

BRISTOL, CN (3-15-16) A Middlefield man has been charged with drunkenly shooting himself at the Bristol Polish American Club.

Derrick Schultz, 35, was allegedly drinking at the club’s bar on Feb. 4 around 3:50 p.m., when he accidentally fired off the handgun he had on him, injuring his scrotum, according to the arrest warrant.

According to police, there were other people inside the club when the gun went off, but they did not report any injuries.

Schultz was arrested over the weekend on charges of unlawful discharge of a firearm, first-degree reckless endangerment, illegally carrying a firearm under the influence, second-degree breach of peace and third-degree criminal mischief.

Police responded to the Polish American Club, 541 North Main St., on Feb. 4 on the report of a shot fired, but Schultz had already left, police said.

Officers used his cell phone number from his club membership application to call Schultz and find that he was at his friend’s house on Farmington Avenue. Police went to the home, where Schultz came out with portions of his pants blood-soaked.

Officers seized a Ruger handgun from him, and he was brought to Saint Francis Hospital in Hartford. The injury was not life-threatening.

A search warrant for Schultz’s medical records would later indicate that his blood alcohol content was 0.12, according to police.

Schultz, who is free on a $2,500 non-surety bond, is scheduled to be arraigned in Bristol Superior Court on Monday.

Grocery store employee accidentally shot by manager

Chicago, Il (3-14-16) An employee at a Northlake grocery store was taken to the hospital last week after being accidentally shot by his manager, according to police.

Luis Hernandez, 36, has been an employee at Farmer's Best Market, 23 W. North Ave., for 11 years and was promoted to manager about five months ago. Hernandez was in the grocery store's security office on March 9 when he said he saw a firearm sitting on a desk that belongs to another store manager who is also a licensed security guard.

When Hernandez touched the gun he accidentally fired a bullet that traveled through the wall of the security office and into the front end of the store, striking a 41-year-old employee in the ankle while he was bagging groceries, police said.

"When I went to move it I thought the safety was still on. I didn't know it would go off like that," said Hernandez. "I didn't want that to happen."

Once officers were on the scene at 3:47 p.m., they had the employee taken to Gottlieb Memorial Hospital in Melrose Park for treatment.

The shooting was later ruled accidental and no criminal charges were filed, said Northlake Deputy Chief of Police Jay Militello.

However, while Hernandez was in custody, officers saw he had a warrant out of DuPage County for failing to appear for a DUI. Hernandez said he has been released on bond on that charge.

"I spoke to [the employee] just the other day to apologize for what happened," said Hernandez. "He told me it was OK and understood it was an accident."

NYPD sergeant fired shot that accidentally hit plainclothes detective in buy-and-bust on Brooklyn street, sources say

New York NY (3-15-16)  Cops gather on Bushwick street corner after one of their own was shot in a friendly fire incident Tuesday in a buy-and-bust gone bad. An NYPD sergeant fired the bullet that wounded another cop during a heroin buy-and-bust that went bad on a Brooklyn street, sources said Wednesday.

Sgt. Sean Honstetter, an 11-year veteran, accidentally shot plainclothes Detective Jon Gladstone during the Tuesday night scuffle where one of the suspects took three gunshots, sources said.

A pair of suspected drug dealers sparked the gunfire when they tried to run down both cops with a minivan after an $80 undercover heroin purchase on Wilson Ave. near Troutman St., police said. Police gather at scene at the corner of Wilson Ave. and Troutman St., in Bushwick, Brooklyn, after a plainclothes cop was shot in the shoulder. The two officers were graduates of the same Police Academy class in January 2005. Gladstone, of Brooklyn North Narcotics, was shot in the shoulder and rushed to Elmhurst Hospital — where he was expected to make a full recovery.

It was the third friendly-fire shooting of a city cop in the first three months of 2016.

Both Gladstone and Honstetter, who turned 33 on Wednesday, fired at the suspects as they tried to flee the scene in a minivan.

Suspect Oscar Vera, 45, was struck once in the leg and twice in the arm before the minivan slammed into another vehicle and came to a halt in Bushwick. Cops said he was behind the wheel and had a rap sheet with 58 prior arrests.

The bleeding Vera was arrested along with suspect Geraldo Rodriguez, 51. Honstetter and Gladstone fired four shots between them Tuesday night, cops said. Detective Jon Gladstone was rushed to Elmhurst Hospital Center after the shooting. He’s expected to make a full recovery. The two cops had pulled their vehicle in front of the minivan as a second police car pulled up from behind, blocking any escape route.

When the two officers left their vehicle and identified themselves as cops, the minivan driver put the vehicle in reverse, slammed into the second police car and then drove forward.

Gladstone was partially inside the minivan as it lurched around the crime scene before crashing, cops said.
